Affiliate Terms

These Affiliate Programme Terms & Conditions ("Terms") apply to individuals, businesses, publishers, content creators, influencers and other partners ("Affiliates") who participate in the Harmonista affiliate programme.

The programme may be operated through one or more third-party affiliate networks, tracking platforms or directly by Harmonista. These Terms apply regardless of which platform or network is used to manage an Affiliate relationship.

By applying to, being accepted into, or participating in the Harmonista Affiliate Programme, you agree to comply with these Terms, together with any additional terms or requirements communicated to you by Harmonista or the relevant affiliate network.

1. About Harmonista

Harmonista is an online retail brand offering products across areas including self-care, wellness, mindful living, aromatherapy, crystals and spirituality, home décor, lifestyle, bath and body, jewellery, clothing, accessories and gifts.

2. Joining the Affiliate Programme

Affiliates must provide accurate and complete information when applying to the programme.

Harmonista reserves the right to:

  • Approve or reject any Affiliate application at its discretion.

  • Request additional information about an Affiliate's website, social media accounts, promotional methods or audience.

  • Decline or remove websites, social media accounts or promotional channels that are considered unsuitable for the Harmonista brand.

  • Suspend or terminate an Affiliate's participation where these Terms are breached.

Affiliate approval does not guarantee that an Affiliate will receive commission or that any particular level of sales or earnings will be achieved.

3. Affiliate Commission

The applicable Affiliate commission rate will be communicated through the relevant affiliate network, platform or direct Affiliate arrangement.

Unless otherwise stated, commission is calculated on qualifying sales attributed to the Affiliate, subject to the applicable network's tracking and validation rules.

Harmonista may change commission rates from time to time. Where required, changes will be communicated through the relevant affiliate network or Affiliate account.

Commission may not be payable on:

  • Cancelled orders

  • Refunded or returned orders

  • Failed or fraudulent transactions

  • Orders that are not successfully tracked

  • Orders that do not meet the programme's qualifying criteria

  • Orders generated through prohibited promotional methods

  • Orders placed by the Affiliate for their own benefit where self-referrals are prohibited

4. Returns, Refunds and Cancelled Orders

Where an order is subsequently cancelled, refunded, returned or otherwise determined not to qualify, any associated Affiliate commission may be reversed or withheld in accordance with the applicable affiliate network's rules.

Harmonista reserves the right to review transactions before commission is confirmed.

5. Affiliate Tracking and Attribution

Affiliate sales are tracked using links, cookies, promotional codes, tracking technology or other attribution methods provided by Harmonista or its affiliate network partners.

Harmonista does not guarantee that every customer interaction or transaction will be successfully tracked.

Where a customer interacts with multiple marketing channels, affiliate links, promotional codes or affiliate networks before completing a purchase, Harmonista may apply its attribution and de-duplication rules.

Only one Affiliate commission will normally be payable on an individual transaction unless Harmonista expressly agrees otherwise.

Harmonista reserves the right to determine the applicable attribution method where multiple marketing channels or Affiliate networks are involved.

6. Multiple Affiliate Networks

Harmonista may operate Affiliate relationships through more than one affiliate network, tracking platform or direct partnership.

Affiliates must comply with:

  • These Harmonista Affiliate Terms;

  • The applicable affiliate network's terms and conditions;

  • Any specific programme rules communicated through the relevant affiliate network; and

  • Any additional promotional restrictions communicated by Harmonista.

Where there is a conflict between these Terms and mandatory requirements imposed by the relevant affiliate network, the applicable network requirements may also apply to the Affiliate's participation.

7. Advertising and Affiliate Disclosure

Affiliates must make it clear when their content constitutes advertising or includes an Affiliate relationship.

Affiliate links, promotional codes and other content through which an Affiliate may earn commission must be presented honestly and transparently.

Affiliates must comply with applicable UK advertising and consumer protection requirements, including the applicable provisions of the CAP Code.

Where disclosure is required, Affiliates should use clear wording such as "Ad" or another clear and prominent disclosure appropriate to the platform.

Terms such as "affiliate", "aff" or "afflink" alone may not be sufficient to make the commercial nature of content clear to consumers.

The ASA states that affiliate marketing is subject to the CAP Code and that affiliate content must be obviously identifiable as advertising where the commercial nature is not otherwise clear.

8. Honest and Accurate Promotion

Affiliates must ensure that all promotional content relating to Harmonista is:

  • Accurate and truthful;

  • Not misleading;

  • Not exaggerated or deceptive;

  • Based on information that can reasonably be supported;

  • Presented in a way that does not create a false impression about Harmonista, its products, prices, offers or services.

Affiliates must not make claims about Harmonista products that are not supported by the product information supplied by Harmonista.

Affiliates must not make medical, therapeutic or other regulated claims about products unless such claims have been expressly authorised by Harmonista and are legally permitted.

9. Product Reviews and Recommendations

Affiliates may review or recommend Harmonista products provided that their content is genuine, accurate and not misleading.

Affiliates must not:

  • Invent reviews or testimonials;

  • Present paid or incentivised opinions as independent consumer experiences;

  • Make false claims about having personally used a product;

  • Misrepresent product specifications or benefits;

  • Make unsupported health or therapeutic claims.

Where an Affiliate receives a product free of charge or receives another benefit in connection with promotional content, the Affiliate must comply with applicable disclosure requirements.

10. Social Media

Affiliates may promote Harmonista through appropriate social media channels.

Affiliate content must comply with the rules and requirements of the relevant social media platform as well as applicable UK advertising requirements.

Where Affiliate content is advertising, the commercial nature must be made clear to consumers before or when they engage with the content.

Affiliates must not create accounts, pages or profiles that falsely suggest they are operated by Harmonista.

11. Email Marketing

Affiliates must comply with applicable laws and regulations governing direct marketing and electronic communications.

Affiliates must not send unsolicited bulk emails promoting Harmonista.

Affiliate emails must be sent only to recipients for whom the Affiliate has the appropriate permission or other lawful basis to send the communication.

Emails must not falsely suggest that they have been sent by Harmonista.

12. Paid Search and PPC Advertising

Affiliates must not bid on Harmonista's brand name, trademarks, misspellings or other brand-related search terms through paid search advertising unless Harmonista has expressly authorised this in writing or through the applicable Affiliate Programme terms.

Affiliates must not create advertisements that could reasonably be mistaken for advertisements operated directly by Harmonista.

Harmonista may impose additional PPC restrictions through an affiliate network or Affiliate account.

13. Brand Name, Logos and Images

Harmonista may provide approved logos, product images, descriptions, banners, links and other marketing materials for Affiliate use.

Affiliates may use these materials solely for promoting Harmonista through the Affiliate Programme.

Affiliates must not:

  • Alter Harmonista logos in a misleading way;

  • Register domains containing Harmonista trademarks without permission;

  • Create social media accounts using Harmonista branding in a way that suggests official ownership;

  • Use Harmonista materials to promote unrelated products or services;

  • Suggest that they are an employee, representative or official agent of Harmonista.

Harmonista may require an Affiliate to remove or amend any promotional material that it considers inappropriate or inconsistent with the brand.

14. Discount Codes, Vouchers and Promotional Offers

Affiliates may only advertise discount codes, vouchers and promotional offers that have been provided or authorised by Harmonista or the relevant Affiliate network.

Affiliates must not:

  • Create unofficial Harmonista discount codes;

  • Advertise expired offers as current;

  • Misrepresent the terms or value of an offer;

  • Use a discount code in a way that is intended to circumvent Affiliate tracking or attribution rules.

Harmonista reserves the right to withdraw or change promotional codes and offers at any time.

15. Cashback, Loyalty and Incentive Sites

Cashback, loyalty, rewards and incentive Affiliates may participate where expressly accepted into the Harmonista Affiliate Programme or permitted through the relevant affiliate network.

Any restrictions relating to cashback, voucher or loyalty promotion may be communicated through the relevant Affiliate network or Affiliate account.

16. Prohibited Promotional Methods

Affiliates must not use:

  • Fraudulent or deceptive traffic;

  • Automated traffic intended to generate commissions;

  • Forced clicks;

  • Cookie stuffing or cookie dropping;

  • Misleading redirects;

  • Malware, spyware or other malicious software;

  • Fake websites or fake social media accounts;

  • Fake reviews or testimonials;

  • Spam;

  • Unauthorised use of personal data;

  • Misleading claims about Harmonista;

  • Any method designed primarily to generate commission without genuine customer interest.

Affiliates must not deliberately interfere with the tracking, attribution or operation of the Affiliate Programme.

17. Self-Referrals and Personal Purchases

Affiliates must not use their own Affiliate links or promotional methods to generate commission on purchases for themselves, their household or associated businesses where this is prohibited by the applicable Affiliate Programme or network rules.

Harmonista reserves the right to withhold or reverse commission on transactions that it considers to be self-referrals, artificial transactions or otherwise inconsistent with the purpose of the Affiliate Programme.

18. Compliance with Laws and Regulations

Affiliates are responsible for ensuring that their promotional activities comply with all applicable laws, regulations, advertising rules and platform policies.

This includes, where applicable:

  • UK advertising requirements;

  • Consumer protection legislation;

  • Data protection and privacy requirements;

  • Electronic marketing requirements;

  • Intellectual property laws;

  • Social media platform rules;

  • Applicable requirements relating to promotions, competitions and prize draws.

19. Affiliate Network Requirements

Where an Affiliate participates through a third-party Affiliate network, the Affiliate must also comply with the applicable network's terms, policies and programme-specific rules.

Harmonista may communicate additional restrictions or requirements through the relevant Affiliate network.

20. Monitoring and Compliance

Harmonista reserves the right to monitor Affiliate activity for compliance with these Terms.

Where Harmonista reasonably believes that an Affiliate has breached these Terms, it may:

  • Request that promotional content is amended or removed;

  • Withhold or reverse commission where permitted;

  • Suspend the Affiliate account;

  • Terminate the Affiliate relationship;

  • Refer the matter to the relevant Affiliate network;

  • Take other appropriate action.

21. Suspension and Termination

Either Harmonista or an Affiliate may terminate the Affiliate relationship in accordance with the applicable Affiliate network's terms or any specific agreement between the parties.

Harmonista may suspend or terminate an Affiliate immediately where there is reasonable suspicion of:

  • Fraud;

  • Abuse of the Affiliate Programme;

  • Misleading or unlawful advertising;

  • Serious breach of these Terms;

  • Harm to the Harmonista brand or reputation;

  • Unauthorised use of Harmonista intellectual property;

  • Manipulation of Affiliate tracking or attribution.

Following termination, Affiliates must stop promoting Harmonista and remove Harmonista Affiliate links, promotional codes and other programme materials where requested.

22. Commission Following Termination

Any commission payable following termination will remain subject to the applicable Affiliate network's validation, refund, cancellation and payment rules.

Transactions that are cancelled, refunded, fraudulent or otherwise invalid may not qualify for commission.

23. Changes to These Terms

Harmonista may update these Affiliate Terms from time to time to reflect changes to the Affiliate Programme, applicable laws, advertising requirements, technology or business practices.

The latest version will be made available on the Harmonista website.

Continued participation in the Affiliate Programme following an update may constitute acceptance of the revised Terms, subject to any notice or acceptance requirements imposed by the applicable Affiliate network.

24. No Guarantee of Earnings

Participation in the Harmonista Affiliate Programme does not guarantee any particular level of traffic, sales, commission or earnings.

Affiliates are responsible for their own marketing activities, costs and expenses.

25. Relationship Between Harmonista and Affiliates

Participation in the Affiliate Programme does not create an employment, agency, partnership, joint venture or franchise relationship between Harmonista and an Affiliate.

Affiliates are independent promotional partners and have no authority to enter into contracts, make commitments or incur liabilities on behalf of Harmonista.

26. Intellectual Property

All trademarks, logos, product imagery, written content and other intellectual property belonging to Harmonista or its suppliers remain the property of their respective owners.

Participation in the Affiliate Programme does not transfer ownership of any intellectual property to an Affiliate.

27. Liability

Harmonista will not be responsible for any loss of income, anticipated commission, traffic or business opportunity arising from participation in the Affiliate Programme.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by law.

28. Governing Law

These Terms and any dispute or claim arising from them shall be governed by the laws of England and Wales.

The courts of England and Wales shall have jurisdiction over disputes arising in connection with these Terms, subject to any applicable mandatory legal requirements.

Harmonista reserves the right to approve Affiliates, determine qualifying transactions, apply applicable attribution rules and take appropriate action where these Terms are breached.
